Solicitud de nulidad de la Sentencia T-093/23.
El recurrente, en calidad de tercero vinculado, mencionó cuatro reparos y/o desacuerdos frente a lo decidido por la Sala de Revisión, los cuales, en su criterio, lesionan el debido proceso, por lo que la tutela debió decidirse como medida transitoria.
La Corte concluyó que la petición no satisfizo el exigente requisito de carga argumentativa que requiere la formulación de incidentes de nulidad.
Ello, por cuanto no se presentó argumentación estricta que demuestre la ostensible, probada, significativa y trascendental afectación al derecho fundamental al debido proceso, con repercusiones sustanciales y directas en la decisión o en sus efectos.
Aunado a lo anterior, concluyó la Sala Plena que la pretensión real era abrir el debate respecto de asuntos que fueron tenidos en cuenta para tomar la decisión controvertida.
Con base en lo anterior, se RECHAZA la nulidad deprecada.
